Time for Action and Lobby Day: Gun Violence Prevention

March 9, 2009

HB48 - FOID Card Act - Private Sales

FROM:       Michelle Jordan & Barbara Marsh, Gun Violence Prevention Issue Specialists
Syvia Tillman, LWVIL Issues Vice president

ACTION NEEDED: Contact your State Representatives and urge them to Vote for HB 48 which requires background checks on all handgun transfers in Illinois.  This bill may be called for a vote in the Illinois House by Thursday, March 12.  Please urge them to vote DO Pass.

BACKGROUND:  LWVIL is a strong supporter of gun violence prevention and gun control. During the 94the General Assembly, Illinois closed the gun show loophole by passing Senate Bill 1333, a bill that required background checks for transfer or sales conducted at gun shows.  Because of that law, the Illinois State Police estimate that hundreds of prohibited transfers are prevented each year.   People who legally should not be allowed to purchase weapons were denied them based upon a background check conducted at a gun show.

The only remaining category that does not currently require a background check in Illinois is the private sale transfer.  Unfortunately, this accounts for nearly 40% of all transfers in Illinois.   HB48 would require a background check on private gun sales. This bill is the natural extension of the gun show background check legislation that was so strongly supported in 2005 and is equally as vital.

BILL STATUS: HB 48 on 2nd reading in the House of Representatives
Vote expected by March 12, 2009
Ask for a Do Pass vote on HB 48
